01 · AGREEMENT

Using Elah.fm means accepting these terms.

By accessing Elah.fm, listening to HypnoPop, purchasing a personalized HypnoPop product, completing an Elah AI Intake or otherwise using our services, you agree to these Terms of Service.

If you do not agree with these Terms, please do not use the services.

You must have the legal capacity to enter into an agreement where you live. If consent from a parent, guardian or another authorized person is required by applicable law, that consent must be obtained before using a paid personalized service.

02 · HYPNOPOP SERVICES

Music created with intention.

Elah.fm provides HypnoPop music and related experiences built around repetition, hypnotic language, suggestion, music and intentional self-talk.

Some HypnoPop music is available publicly through Elah.fm.

Elah.fm also offers personalized HypnoPop experiences created around an individual's selected goal and information gathered through the Elah conversational AI Intake.

03 · PERSONALIZED HYPNOPOP

Your album is created for your goal.

A standard personalized HypnoPop purchase includes a 10-song album created around the goal selected for that project.

The songs may incorporate themes, language, metaphors, motivations, desired outcomes and other relevant information gathered during your intake.

Personalized HypnoPop is a custom creative service. The exact lyrics, musical styles, arrangements, production choices and creative direction are determined as part of the creation and curation process.

Purchasing a personalized album does not guarantee that every statement, phrase or detail provided during the intake will appear directly in a song.

04 · ELAH AI INTAKE

The conversation guides the creation.

Personalized HypnoPop requires completion of the Elah conversational AI Intake unless we specifically state otherwise.

The intake is not a hypnosis session.

It is a guided conversation designed to gather context that may be useful when creating your personalized music.

You are responsible for providing information that is accurate enough for us to understand the goal you want the project to address.

Human review

A trained hypnotist is assigned to review the information relevant to your personalized project.

The hypnotist may contact you if additional information or clarification would help with the creation of your album.

If clarification is required and we cannot reasonably continue without your response, completion may be delayed until the requested information is received.

05 · CREATION & DELIVERY

Created, reviewed and delivered.

The standard delivery period for a personalized HypnoPop album is within seven days after the required AI Intake has been completed.

During that period, intake information may be reviewed, lyrics developed, music produced and the completed collection curated.

Your completed album is delivered through a private Elah.fm link.

Personalized songs are provided as downloadable MP3 files.

Once downloaded, you may listen to your music as often as you like for your permitted personal use.

You are responsible for maintaining your own copies of downloaded files.

06 · VARIATIONS & ADDITIONAL MUSIC

Familiar language. More ways to hear it.

A personalized HypnoPop album includes five additional song variations at no additional charge.

Variations may use different musical styles, arrangements, pacing, production or other creative treatments while drawing from the same personalized project.

Additional music for the same goal

You may purchase additional HypnoPop music for the same goal without completing another intake, provided the existing intake remains appropriate for that project.

Music for a different goal

If you want personalized HypnoPop for a different goal, a new AI Intake is required.

This allows the new project to be created using information relevant to the new goal rather than relying on context gathered for a different one.

07 · PAYMENTS

Payment begins the process.

Prices are shown before purchase and may change from time to time.

Payment for personalized HypnoPop services is processed through Stripe or another payment provider identified at checkout.

You agree to provide valid payment and purchase information and authorize the applicable amount shown at checkout.

Your personalized creation period does not begin until both payment and the required intake have been completed.

08 · PERSONALIZED PURCHASES

Custom work begins for you.

Personalized HypnoPop is custom digital content created specifically for an individual purchaser.

Because creation work begins based on your purchase and intake information, personalized HypnoPop purchases are final and are not refundable once the personalized creation process has begun, except where a refund is required by applicable law.

If you experience a technical delivery issue or believe you did not receive what was included with your purchase, please contact us so we can investigate and assist.

09 · PERMITTED USE

Your music is for your personal use.

Unless we agree otherwise in writing, personalized HypnoPop is provided for personal, non-commercial listening and use.

You may download your delivered files and play them on your personal devices.

You may not sell, sublicense, commercially distribute, publicly upload, republish or commercially exploit personalized HypnoPop recordings without written permission.

These Terms do not transfer ownership of the Elah.fm name, HypnoPop name, platform, technology, production systems, trademarks, website materials or other Elah.fm intellectual property.

Rights in individual music, lyrics, recordings and AI-assisted creative material may also be subject to applicable law and the terms of technology or production services involved in their creation.

10 · WELLNESS DISCLAIMER

HypnoPop is not medical treatment.

HypnoPop and the Elah AI Intake are intended as personal development, creative and wellness experiences.

They are not medical care, psychotherapy, psychiatric treatment, diagnosis or emergency services.

Information provided through Elah.fm should not be used as a substitute for advice, diagnosis or treatment from a qualified healthcare professional.

If you have a medical or mental health concern, consult an appropriately qualified professional.

If you are experiencing an emergency, contact the appropriate emergency service in your area.

11 · RESULTS

Repetition is part of the experience.

HypnoPop is designed around intentional repetition, music, language and self-talk.

Individual experiences vary.

Elah.fm does not guarantee a particular psychological, emotional, behavioral, professional, financial, physical or other outcome from listening to HypnoPop.

Statements describing the philosophy, intention or design of HypnoPop should not be interpreted as guarantees of individual results.

12 · THIRD-PARTY SERVICES

Technology supports the experience.

Elah.fm may use third-party services for payment processing, hosting, AI processing, transcription, music production, communications and other operational functions.

Your use of certain third-party services may also be subject to their own terms and privacy practices.

Elah.fm is not responsible for independent third-party websites, services or systems outside our control.

13 · SERVICE AVAILABILITY

We keep building and improving.

Elah.fm, its music library, AI Intake, delivery systems and related features may change as the service develops.

We may update, replace, suspend or discontinue features when reasonably necessary.

We do not guarantee that every feature or service will be available without interruption at all times.

Temporary outages, maintenance, third-party failures or other technical issues may occasionally affect access.

14 · LIMITATION OF LIABILITY

Reasonable limits apply.

To the maximum extent permitted by applicable law, Elah.fm and those involved in providing the service will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of, or inability to use, Elah.fm or related services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

15 · CHANGES TO THESE TERMS

These terms may evolve.

We may update these Terms as Elah.fm, HypnoPop and related services evolve.

When the Terms are updated, the effective date shown at the top of this page will also be updated.

Continued use of the service after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
